音声SNSのクラブハウスが、破竹の勢いでユーザー数を増やしています。クラブハウスには、利用規約が制定されていますが、ほとんどのユーザーが利用規約を目にしたことはありません。それ故、どんなルールがあるのかもも知らないまま利用しているかもしれませんね。利用規約を知らないまま、規約違反行為を繰り返していると、アカウント停止になるかもしれません。毎日、楽しく参加できていたグループに、ある日、突然入れなくなる。こんな事態にならないように、利用規約を確認してみましょう。クラブハウス利用者は、クラブハウス運営会社が掲げる利用規約に同意している前提で、サービスを利用していることになっています。参考までに、末尾に英文の利用規約を引用しています。なお、規約本文の日本語訳に際して、Deeplを使用した後、一部改変しています。
クラブハウスには会話内容の禁止規定がある
項目１にて、取り上げてはならない会話内容について、７項目定めています。他人の知的財産を侵害するコンテンツ、プライバシー侵害、未承諾または無許可の広告、販促物、商業活動および/または販売等の禁止事項は判断基準は設定しやすいと思います。しかし、判断基準の難しい項目も含まれています。特に、項目７の「アルファ・エクスプロレーション（＝クラブハウス提供会社）が独自に判断したもの」は、判断の基準が曖昧です。いずれにしても、誰に聞かれても問題のない内容にとどめておくことが無難と言えます。
以下、禁止されている全７項目詳細
- 知的財産権またはその他の所有権を侵害している
- 法律の下で、または契約上または受託者関係の下でアップロードする権利を持っていない
- ソフトウェアウイルスやその他のコンピュータコード、ファイル、またはコンピュータソフトウェア、ハードウェア、または通信機器の機能を中断、破壊、または制限するように設計されたプログラムが含まれている
- プライバシーまたはセキュリティのリスクを生じさせる
- 未承諾または無許可の広告、販促物、商業活動および/または販売、「ジャンクメール」、「スパム」、「チェーンレター」、「マルチ商法」、「コンテスト」、「懸賞」、またはその他の勧誘を構成するもの
- 非合法、有害、脅迫的、脅迫的、虐待的、嫌がらせ、不法行為的、過度に暴力的、中傷的、下品、猥褻、ポルノ的、誹謗中傷的、他人のプライバシーを侵害するもの、人種的、民族的、その他の好ましくないもの
- アルファ・エクスプロレーション（＝クラブハウス提供会社）が独自に判断したもの
クラブハウスには録音・記録の禁止規定がある
「クラブハウスは録音禁止です」ということを聞いたことがあるかもしれません。iPhoneを操作して録音をしようとすると、iPhoneの画面上に警告文が表示されます。アプリで、録音可能な機器や他のアプリへの接続を監視していると推測されます。こんな警告が出てきたら、びっくりしますよね。筆者は、外付けスピーカー(Bose Sound Link mini)に接続したときに、この警告文に遭遇しました。
ところで、英文規約にあるrecordは、録音と理解しないほうがいいのかもしれません。規約の項目２では、”record any portion of a conversation without the express written consent of all of the speakers involved”と規定されています。日本語に訳すと、「関係する話者全員の書面による同意なしに、会話のいかなる部分を録音すること」と訳すことができるので、「録音は禁止」と言われます。しかし、英語のrecordには、録音を含めた記録の意味があります。従って、メモを取ることも、禁止事項に抵触する可能性があります。但し、実際には、メモを取っているかどうかは追跡のしようがありません。アルファ・エクスプロレーションが規約の日本語版を提示した際に、改めて確認してみましょう。
クラブハウスには、オフレコ他言無用の規定がある
規約の項目３にて、”share information (on Clubhouse or elsewhere) that the speaker explicitly stated was to be treated as “off the record””、日本語に訳すと、『発言者が「オフレコ」として扱われるべきだと明示的に述べた情報を（クラブハウスまたはその他の場所で）共有する。』と規定されています。分かりやすく言い換えると、「ここだけの話だけど」という前提の話を、他所に広めてはいけない、ということを謳っています。しかし、そもそも、一般公開で、不特定多数の人がroomに入ってきて話を聞くわけです。「オフレコ」なんて機能するわけありません。それでも、利用規約として、このような規定を入れている意図はどこにあるのでしょうか？少々、不思議な禁止事項ですね。
クラブハウス利用規約違反と思われる事例
このような事例がtwitterで挙がっています。記録した点、および、口外した点でクラブハウスの利用規約に抵触するとも言えます。とはいえ、先述の通り、不特定多数の聴衆が存在する場での会話であることを認識していないことも、問題と言えるのではないでしょうか？規約違反と言っても、拡散されてしまった発言した内容を回収することはできません。

6. impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
7. solicit personal information from anyone under the age of 18;
8. harvest or collect email addresses or other contact information of other users from the Service by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
9. advertise or offer to sell or buy any goods or services for any business purpose that is not specifically authorized;
10. promote or aid in the building of a competitive product or service, copy the Service’s features or user interface, or solicit users or customers from the Service;
